My Web Gem – Gold Coast Short-Term Rental Websites

1. Agreement to Terms
These Terms & Conditions (“Terms”) govern your access to the My Web Gem website and any services provided by My Web Gem.
By accessing our website or engaging our services, you agree to these Terms, our Privacy Policy, and our Disclaimer.
If you do not agree, you must not use our website or services.
2. Services
My Web Gem provides website design, development, SEO foundations, direct booking integration, maintenance, and related digital services for short-term rental and holiday accommodation operators.
Services are provided in accordance with:
• A written proposal
• A Master Services Agreement (MSA), where applicable
• A Statement of Work (SOW)
• Or a written invoice outlining scope
Any work outside the agreed scope may incur additional fees.
3. Deposits & Payment
Website build projects require a 50% deposit prior to commencement. Work will not begin until the deposit is received.
The remaining balance is payable in accordance with the agreed invoice terms.
Ongoing services (including website maintenance or SEO services) are billed monthly where selected.
If payment is overdue, My Web Gem may:
• Suspend services
• Withhold deliverables
• Disable hosting or access (where applicable)
• Terminate services after reasonable notice
Deposits are non-refundable once work has commenced, except where required under Australian Consumer Law.
4. Client Responsibilities
Clients agree to:
• Provide accurate, lawful, and complete content
• Ensure compliance with all applicable laws and STR regulations
• Obtain rights, licences, and permissions for supplied materials
• Provide timely feedback and approvals
• Provide necessary access credentials when required
Delays caused by failure to provide required materials or approvals may result in timeline extensions and additional fees.
My Web Gem is not responsible for the legality, compliance, or accuracy of client-provided content.
5. Scope Variations
Any request outside the agreed scope of services may:
• Be quoted separately
• Be billed at an agreed hourly rate
• Extend project timelines
Verbal requests do not alter the agreed scope unless confirmed in writing.
6. Intellectual Property
Clients retain ownership of their supplied content (text, images, property details).
My Web Gem retains ownership of:
• Proprietary frameworks
• Design systems
• Structural layouts
• Templates
• Underlying processes and tools
Upon full payment, clients receive a non-transferable licence to use the completed website for their business purposes.
Unless otherwise agreed in writing, the licence does not permit resale, redistribution, or replication of the website framework.
7. SEO & Performance
My Web Gem applies recognised best practices in website structure and search engine optimisation.
However, we do not guarantee:
• Search rankings
• Indexing outcomes
• Traffic levels
• Booking volumes
• Revenue increases
Search engine ranking decisions are made solely by third-party search engines and are outside our control.
8. Third-Party Services & Integrations
Websites may rely on third-party platforms including booking engines, payment gateways, plugins, hosting providers, analytics tools, and channel managers.
My Web Gem does not control and is not responsible for:
• Third-party outages
• Policy changes
• Security breaches
• Pricing changes
• Data handling practices
• Service interruptions
Use of third-party services is at your own risk.
9. Hosting & Maintenance
Where maintenance or hosting services are selected:
• My Web Gem will use reasonable care and skill
• We do not guarantee uninterrupted availability
• We cannot guarantee protection against all cyber threats
Clients remain responsible for maintaining appropriate insurance and business continuity planning.
Maintenance services may be cancelled with 30 days’ written notice unless otherwise agreed in writing.
10. Limitation of Liability
To the maximum extent permitted by law, My Web Gem is not liable for any indirect, incidental, special, or consequential loss arising from the use of our website or services.
Total liability is limited to the total fees paid by the client for the relevant services.
Nothing in these Terms excludes, restricts, or modifies any non-excludable rights under the Australian Consumer Law. Where liability cannot be excluded, it is limited to the re-supply of services or the cost of re-supplying services.
11. Indemnity
Clients agree to indemnify and hold harmless My Web Gem from any claims, liabilities, damages, or expenses arising from:
• Client-provided content
• STR operations or guest disputes
• Regulatory non-compliance
• Misuse of the website
12. Termination
Either party may terminate services in writing.
Fees for work completed to date remain payable.
Deposits are non-refundable once work has commenced, except where required by law.
13. Force Majeure
My Web Gem is not liable for delays or failure to perform services due to events beyond reasonable control, including but not limited to internet outages, cyber incidents, supplier failures, natural disasters, or government restrictions.
14. Privacy
Personal information is handled in accordance with our Privacy Policy.
15. Changes to Terms
These Terms may be updated at any time. Continued use of our website or services constitutes acceptance of revised Terms.
16. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes are subject to the exclusive jurisdiction of Queensland courts.
